Administrative Litigation

CBL attorneys have wide rate case and administrative litigation experience, having represented clients in over a dozen major rate hearings before the Federal Energy Regulatory Commission (FERC). We have represented clients in state administrative litigation as well, including proceedings before the Regulatory Commission of Alaska and the California Public Utilities Commission. As a result of our extensive administrative litigation experience, CBL attorneys are well-versed in almost every aspect of ratemaking, including cost of capital, income tax allowance, rate design, operating expense issues, and prudence challenges. Many of the cases we have handled in the past several years have been precedent-setting, resulting in ground-breaking orders from FERC on issues such as the income tax allowance, overhead allocations, and oil pipeline rate indexing. We have successfully represented our clients in appeals of such orders before the United States Court of Appeals for the District of Columbia Circuit.
