Appellate

CBL has significant appellate experience, having handled appeals in some of the most significant pipeline regulatory matters during the last decade. Selected engagements of CBL attorneys have included:

  • Representing SFPP, L.P., a subsidiary of Kinder Morgan Energy Partners, L.P., in obtaining an opinion from the D.C. Circuit upholding FERC’s income tax allowance policy, a major victory for oil and natural gas pipelines owned through master limited partnerships and other tax-pass-through entities. ExxonMobil Oil Corp. v. FERC, 487 F.3d 945 (D.C. Cir. 2007).
  • Representing SFPP, L.P. before the D.C. Circuit in successfully defending FERC’s rejection of complaints against its rates and upholding FERC's approach to indexing of oil pipeline rates. ExxonMobil Oil Corp. v. FERC, 2010 U.S. App. LEXIS 2620; 363 Fed. Appx. 752 (D.C. Cir. Feb. 5, 2010).
  • Representing Calnev Pipe Line, a subsidiary of Kinder Morgan Energy Partners, L.P., before the D.C. Circuit in successfully defending FERC's rejection of complaints against its indexed rates. Tesoro Refining and Marketing Co. v. FERC, 552 F.3d 868 (D.C. Cir. Jan. 23, 2009).
