Other Pipeline Practice (e.g., CO2, Ethylene)

As part of their pipeline practice, CBL attorneys have represented clients in transactions and in matters concerning both federal and state regulation of pipelines carrying CO2, anhydrous ammonia, ethylene, propylene, and coal slurry. At the federal level, some of these pipelines are subject to regulation by the Surface Transportation Board (“STB”) and some have been found to be common law common carriers. Similarly, at the state level, while regulation varies from state-to-state, some of these carriers have been found to be subject to state commission regulation and others regulated as common law common carriers. CBL’s experience in sorting out matters of regulation at the STB and elsewhere in this largely nascent field places us in a unique position to assist clients in these areas.

Moreover, our STB experience goes beyond pipelines. One of our attorneys has extensive experience concerning rail shipper and short line railroad issues (see Multimodal Transportation / Rail). This experience allows us to assist clients in rail related projects and STB matters.
